Welcome to CACFP Solutions LLC (“CACFP Solutions,” “we,” “us,” or “our”). By accessing our website at cacfpsolutions.com, using our software, or engaging our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our website or services.

1. About Our Services

CACFP Solutions LLC is a Texas-based company that provides software tools, consulting services, and ongoing support to help child care centers, adult day care centers, and at-risk after-school programs manage their participation in the Child and Adult Care Food Program (CACFP). Our services include, but are not limited to:

  • CACFP application assistance
  • Digital meal counting, menu planning, and enrollment management software
  • Receipt capture and digital budget tools
  • Monthly claim processing and reporting
  • Administrative review preparation and corrective action plan support
  • CACFP compliance consulting and ongoing program support
  • Training and onboarding for CACFP-related software tools

We are not a CACFP sponsor. We serve as an independent support team that helps centers manage their own CACFP contracts and compliance obligations.

2. Eligibility

Our services are intended for authorized representatives of child care centers, adult day care centers, and at-risk after-school programs operating in the United States. By using our services, you represent that you are at least 18 years of age and have the authority to enter into these Terms on behalf of your organization.

3. User Accounts

Certain features of our services require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account by contacting us at help@cacfpsolutions.com or 512-657-8036.

4. Use of Our Services

You agree to use our website and services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use our services for any purpose that is unlawful or prohibited by these Terms
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Reproduce, distribute, modify, or create derivative works from our software, content, or materials without our prior written consent
  • Misrepresent your identity or affiliation with any person or organization
  • Upload or transmit any viruses, malware, or other harmful code
  • Use our services in any way that could damage, disable, or impair our website or interfere with any other party’s use of our services

5. Service Agreements and Payment

Specific services provided by CACFP Solutions may be governed by separate service agreements, statements of work, or subscription plans. In the event of a conflict between these Terms and a specific service agreement, the service agreement shall control with respect to that particular service.

Fees for our services are outlined at the time of purchase or in your service agreement. All fees are due as specified and are non-refundable unless otherwise stated in your service agreement. We reserve the right to modify our pricing with reasonable advance notice.

6. Intellectual Property

All content, software, designs, logos, text, graphics, and other materials on our website and within our software tools are the property of CACFP Solutions LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software without our express written permission.

7. Third-Party Services and Links

Our website and services may contain links to third-party websites or integrate with third-party platforms (such as MyFoodCloud, Zoho, or payment processors). These third-party services have their own terms and privacy policies, and we are not responsible for their content, practices, or availability. Your use of third-party services is at your own risk.

8. Disclaimer of Warranties

Our services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

CACFP Solutions does not guarantee that our software or services will be uninterrupted, error-free, or completely secure. While we strive to provide accurate CACFP compliance guidance, we do not guarantee specific outcomes with respect to CACFP applications, claims, reimbursements, or administrative reviews. Our services are advisory in nature, and your organization is ultimately responsible for its own CACFP compliance.

9. Limitation of Liability

To the fullest extent permitted by applicable law, CACFP Solutions LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of reimbursements, or business interruption, arising out of or related to your use of our services, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless CACFP Solutions LLC, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to our business, other users, or third parties. 

You may also terminate your use of our services at any time by contacting us in writing at help@cacfpsolutions.com. Thirty (30) days advance notice is required for all termination requests.

Upon termination, your right to use our services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property, disclaimers, limitations of liability, and indemnification.

12. SMS/Text Messaging Terms

By providing your phone number and opting in, you consent to receive recurring automated SMS/text messages from CACFP Solutions. These messages may include service alerts, appointment reminders, account updates, and support communications related to CACFP services.

  • Message Types: Service alerts, appointment reminders, account updates, and support communications.
  • Message Frequency: Varies based on account activity and service needs.
  • Message & Data Rates: Standard rates may apply per your carrier plan. CACFP Solutions is not responsible for carrier charges.
  • Opt-Out: Reply STOP to any message to unsubscribe. You will receive no further messages unless you re-subscribe.
  • Help: Reply HELP or contact help@cacfpsolutions.com / 512-657-8036.
  • Consent is not a condition of purchase.
  • Mobile information will not be shared, sold, or conveyed to third parties for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services used to deliver messages on our behalf.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, practices, or legal requirements. The updated Terms will be posted on our website with the revised effective date. Your continued use of our services after any changes constitutes your acceptance of the revised Terms.
